The Apex Court stated that the reserved candidates of Government school students can be eligible for the Unreserved category and it means that encompasses the whole category of people without any barrier.
- The five-percent of the MBBS seats would be reserved for the Government School Students and the other candidate shall remain be vacant.
- According to the MP Education Admission Rules, 2018, the vacancies were transferred from the GSUR to an URGS category.
- The High Court dismissed the order passed under the MP Education Admission Rules.
The Apex Court mentioned that the eligibility is determined based on the merits of the medical candidates in UGSC also and declared that it is opened for all.
Justice BR Gavai and Justice KV Viswanathan held that the order of MP High court was set aside which refused to allow the admission of the merit candidate to the Unreserved category.
The Court highlighted that the candidates belong to the reserved categories would be entitled to the unreserved category based on their own merit as per the Saurav Yadhav and others V. State of UP and Others.
