In this case, Krishna devotees asserted rights over the land on which Shahi Idgah Mosque is built.
On Tuesday, a last Chance was given by Allahabad High Court to all the Respondents to file their reply by 7th April in a petition for seeking transfer of the Krishna Janmabhoomi case which is pending before Mathura Court to the High Court.
The Court ordered the Respondents i.e Shri Krishna Janmabhoomi Trust, Katra Keshavdev, Management Committee of the Shahi Masjid Idgah next to Krishna Janmabhoomi Temple, Mathura, and Shri Krishna Janmasthan Seva Sanstha, Deeg Gate, Mathura to give their replies via E-mode by 7th April.
The Court also instructed them to file their affidavits through E-mode by 11th April 2023, which is the next hearing date.
In a transfer Petition filed by Hindu Devotees, Justice Arvind Kumar said ” After considering all the facts and situation of the case, the last chance is to be given by April 7th, 2023 and after that, no chance will be given.
On 15th March, the High Court said to all the Respondents to send their replies within 10 days. Then also, the court found that no replies have came yet.
However, the Court had allowed the request for more time and said that” it is clarified that filing of the counter affidavit will be via E-mode of this High Court.
The Petitioner had filed a Civil Suit before the Senior Civil Judge for the declaration of the asserting rights of Hindu Devotees over Shahi Idgah Mosque as this mosque was established after destroying Hindu Temples and therefore such construction cannot be converted into a Mosque as no waqf was ever created and this land was never given for the construction of the Shahi Idgah Mosque.
