Former IT worker Shawn Katz sued TCS in the US on the grounds that non-South Asian and non-Indian applicants and employees were subjected to racial discrimination. Tata Consultancy Services (TCS), an Indian IT services provider, has received some relief from a discrimination lawsuit in a New Jersey court in the United States. A lawsuit was brought against TCS eight months ago for discrimination and breaking visa rules. By dismissing one of the complainant’s three claims, the court has reduced the size of the litigation. The two further claims will be pursued.
Former IT worker Shawn Katz sued TCS in the US on the grounds that non-South Asian and non-Indian applicants and employees were subjected to racial discrimination.
His lawsuit claims that the Indian IT firm consistently discriminates against non-South Asian and non-Indian candidates and workers when making judgments on “hiring, staffing, benching, termination, and promotion decisions” and that this policy is followed top-down at the business.
According to the complaint, TCS discriminates against non-South Asian and non-Indian employees across the board and favors them less when making hiring, staffing, promotion, and termination/retention decisions.
The complaint claimed that he was the victim of unlawful employment practices and disparate impact on the grounds of race and national origin. In addition to damages, he requested injunctive and declaratory relief. TCS replied by submitting a motion to dismiss.
Katz’s claim for a discriminatory impact was dismissed by the New Jersey court because he was unable to make his case.
“TCS’s benching, hiring, and termination policies to maximize visa holders, whom Katz alleges are “almost exclusively South Asian,” followed by TCS giving those visa holders priority for TCS positions, are not facially neutral policies,” the court order stated.
It is important to note that the complainant spent nine years working for TCS before being fired. On December 7, the case was introduced in the District of New Jersey of the United States District Court.
