SUPREME COURT TAKE SUO MOTO COGNISANCE OF FORMER BOMBAY HC (Goa Bench) EMPLOYEES' LETTER ON LACK OF PENSIONARY BENEFITS:

In case : Re Pension Benefits for Employees Retired from High Court of Bombay at Goa V. State of Goa and Ors.

On Monday the Supreme Court took Suo Moto cognisance of a letter written to CJI D.Y Chandrachud by former employees of Goa Bench of Bombay High Court regarding the lack of pensionary benefits rendered to them in spite of the lapse of 3-7 years of retirement.

Advocate Mahfooz A Nazki was appointed as a Amicus Curiae by the Bench comprising Chief Justice D.Y Chndrachud, Justice PS Narasimha, and Justice JB Pardiwala.

The Objection of the Employees was that they were getting provisional pension and inspite of the failure of 3-7 years in accordance with their retirement, they had not received either commutation nor any other benefits. A communication was addressed to Chief Justice by the former employees of Bombay High Court seat at Goa on basis of which suo moto proceedings were reported. The employee said that one of the former employee was driven to suicide because of the mental stress caused by the delay in pension.

The Court said that, “Notice shall be issued by the Registrar General of the High Court of Bombay in two weeks. The Registry shall also cause a copy of the present order together with the underlying communication of the employees to be served on the standing counsel for the State of Maharashtra and Goa.”

Chief Justice D.Y Chandrachud noted during the proceedings that it looks like there is a conflict between State of Maharashtra and State of Goa concerning who should suffer the pensionary liabilities of employees of Goa bench.
