The head of the executive is the president and president is my president-The petitioner said. Justice Narasimha said “we understand why you came up with such petitions but we are not entertaining it under article 32. Be grateful we are not imposing any costs. The petitioner referring to under 79 of the constitution filed the PIL. The vacation bench refused to entertain PIL in seeking directions that new parliament should be inaugurated by the president. The petitioner answered the question that how article 79 is related to the inauguration by remarking that president is the head of the parliament and the executive head is the only head that should open. Article 87 was also cited by the petitioner saying that the session of the parliament will be commenced by the special address of the president. The court was unsatisfied by the petitioner’s argument as they wondered how article 79 is related to the inauguration ceremony. The petitioner asked permission to withdraw the petition.

The petitioner advocate C.R.Jaya Sukin said that the Lok Sabha secretariat violated the law by not inviting the president for the inauguration ceremony of the new Lok Sabha building which is to be held on May 28th 2023.  All the executive actions are taken in the name of the president and the president is the one who appoints the prime minister and other ministers. 19 parties have decided to boycott the ceremony as they remarked that this undignified act violates the spirit of the constitution as the parliament cannot function without the president.
