SHRADDHA WALKER MURDER CASE: DELHI HIGH COURT RESTRAINS NEWS CHANNEL FROM BROADCASTING CONTENTS OF CHARGESHEET:

In case: State of NCT Delhi V. Union of India and Ors.

A notice was issued by Justice Rajnish Bhatnagar on the plea moved by Delhi Police seeking to restrain the news channel from displaying the contents of the chargesheet collected by it till now.

The Court said to the Union of India to get ensured that no channel has the access to the material till it is disposed of. The matter will be heard now on 3rd August.

Last year in May, Shraddha Walker was reportedly killed by his live-in partner Aaftab Poonawalla. Aftab reportedly killed chopped her body into 35- pieces and disposed of it in a forest.

The Delhi Police addressed the High Court after the trial court currently granted it liberty to address a higher forum for seeking relief while restricting only the Aaj Tak news channel from showing the contents of the chargesheet as well as the recording of Narco-Analysis of the accused during the investigation process.

Special Public Prosecutor Amit Prasad appeared for Delhi Police and submitted that the Aaj Tak news channel is restricted by a trial court to display the content in question. He also requested during the hearing that an order has been passed against other news channels broadcasting content that would prejudice the prosecution’s case.

The trial court while restricting the Aaj Tak news channel noticed that any circulation of sensitive information concerning the murder case will cause “Psychological repercussions” for the accused and also the victim’s family.

The court stated that “When the Article 21 of the Constitution protects the life and liberty of a person, it also contemplates a protection of the psychological state of mind of such person.”

The trial court stated that the Aaj Tak News channel “shall not utilize in any form any material” related to the FIR till April 17, which was extended till 20th April.”

Therefore, the Delhi High Court has restricted all-news channels from displaying any material content chargesheet about the Shraddha Murder Case.
