A man who was accused of transporting cows for slaughter was denied bail on May 25 by the Punjab & Haryana High Court, citing the seriousness of the allegations [Shrif v. State of Haryana].

The fact that the accused had failed to explain the omission of concealing the pendency of previous cases against him was also taken into consideration by Justice Gurbir Singh.

“There is no explanation for the apparent concealment of the registration of an earlier case against the petitioner. The single judge stated, “So, petitioner is not entitled to grant of relief in this petition solely on the ground that he has concealed an important fact from this Court.”

In the middle of the night, the petitioner was accused of transporting deplorable cows in a Mahindra Bolero pickup.

The petitioner and others allegedly rammed their vehicle into the complainant’s vehicle and fled when the Bajrang Dal worker who was the complainant attempted to stop them.

The complainant and others followed the car. At that point, the accused are said to have begun throwing stones at the party that was complaining. Additionally, they were accused of attempting to kill the complainant and throwing cows in front of their vehicle.

The petitioner argued that he had been detained since November 2022 and that nothing had been found in his possession.

Nonetheless, the supplication was gone against by the State on the ground that the candidate was engaged with one more case under the Haryana Gauvansh Sanrakshan and Gau Samvardhan Act, which he had not revealed.

This argument was taken into consideration by the Court, which concluded that the petitioner had erred.

Accordingly, it was observed that he was unentitled to bail.

“I am of the view that the petitioner does not deserve the concession of regular bail, at this stage,” Justice Singh stated while dismissing the petition. “Keeping in view the fact that the petitioner has tried to mislead the Court and the gravity of offense,” he added.

The petitioner was represented by Advocate Azad Khan, and the State was represented by Deputy Advocate General Karan Sharma.
