Justice P V Kunhikrishnan from Kerela High Court has granted a 15-day leave to a life convict on the ground for IVF treatment. The request has been moved by the wife of the husband sentenced for the life convict. The court has observed during the hearing that when the cases involve sentencing and conviction it should be based on the reformation and rehabilitation of the accused, as every person should have the chance to live a decent life.

The court has ordered the Director General of Prisons and Correctional Services to allow leave to the man for undergoing the IVF treatment.

Also, while granting relief to the man for IVF treatment, the court has made it clear that this relief should not be taken as a precedent in any cases as of now. The court has observed that every case should be judged on its merit and the judgement of this case should not be the precedent for other convicts to get out of prison.

The husband is presently lodged in the Central Prison and Correctional Services at Viyyur.

The women 31-year-old in her plea before the court had said that they have no children since their marriage in 2012 and it was their dream to have a child and for the treatment it was necessary that her husband was present along with her for three months, she had told the court.
