Gautam Navlakha was active member of banned terrorist group involved in attacks against security forces: Mumbai court

According to Rajesh Katariya, a special judge, there are good reasons to think that Navlakha is guilty of the charges leveled against her.

A Mumbai court rejected the activist’s request for bail, finding that the Bhima Koregaon case suspect Gautam Navlakha was a part of the outlawed terrorist group Communist Party of India (Maoist), which attacked and killed numerous government security forces.

Rajesh Katariya, a Special National Investigation Agency (NIA) judge, expressed his opinion that there were good reasons to believe that Navlakha was guilty of the charges leveled against her in an order that was posted on Wednesday.

“The supplementary charge­sheet and documents relied upon by the prosecution prima facie shows that applicant is active member of said banned terrorist organization and he conducts activities in furtherance of said organization’s object,” the supplemental charge­sheet and documents read by the prosecution state. It also demonstrates that he received weapon training alongside other accused persons, the court ordered..

The chargesheet revealed a connection between Navlakha and Kashmiri separatist Syed Ghulam Nabi Fai as well as Pakistan’s Inter-Services Intelligence (ISI) General, which the sessions court also took into account.

The judge denied Navlakha’s request for bail, saying that “considering the totality of the material, Navlakha’s role cannot be segregated from role of the co-accused in the case and there are reasonable grounds for believing that the accusation against Navlakha are prima facie true.”

Activist for human rights and former People’s Union for Democratic Rights (PUDR) secretary Navlakha was detained in August 2018.

The Supreme Court authorized his plea to be changed back to a month of house arrest on November 10 of last year. This was extended on December 13.

He currently resides in Thane district’s Navi Mumbai city.

On September 5 of last year, Navlakha filed a petition with the High Court after a special NIA court denied his request for bail.

The High Court remanded the case back to the special court after ruling that the bail application needs a new hearing.
