  • The Supreme Court has converted the conviction of a Delhi Police guard, Suraj Kumar, from Section 302 of the Indian Penal Code (IPC) (murder) to Section 304A IPC (causing death by negligence).
  • Kumar was convicted in 2015 for the accidental shooting death of a fellow constable, Manoj Kumar, while they were on duty in Delhi.
  • The Supreme Court found that Kumar had not intended to kill Manoj, and that the shooting was accidental. However, the court also found that Kumar had been negligent in his handling of the pistol, and that his negligence had contributed to Manoj’s death.
  • As a result, the Supreme Court converted Kumar’s conviction to Section 304A IPC, and sentenced him to two years’ imprisonment.
