Although this practice appears to be against the principles of the Civil Code (CPC), it raises important questions about the efficiency and speed of users resolving product conflict issues. “CPC” has set clear rules for both parties to use arbitration. Litigation implies that both parties must have direct or indirect influence on the matter. However, in consumer disputes, there are also cases where only parties involved in the disputed issue are sued. They argue that the Constitution’s emphasis on consumer protection needs a broad interpretation that allows for the inclusion of stakeholders who may directly affect consumers. As customer disputes continue to evolve in the digital age, the need to find a balance between maintaining customer satisfaction and resolving customer disputes through mediation remains a significant challenge. The debate regarding the use of improper parties will continue, prompting lawyers, experts and legislators to consider its relationship to the content of the CPC and the overall goal of consumer protection.
