Tamil Nadu Hindu Religious and Charitable Endowments Act, 1959 has been challenged in a plea filed in the Madras High Court.
A rejoinder has been asked by the bench of the Madras high court comprising Chief Justice Sanjib Banerjee & Justice P.D. Audikasavalu who admitted the plea.
In the proceeding, it was said that the complete act of TN Hindu Religious & Charitable Endowments was being challenged, and not any specific provision of the act stated Adv. R. Gururaj, counsel for the petitioner.
It was asked by CJ Banerjee to the counsel whether they were challenging the whole act, to this, the counsel admitted that as there is not any other act for any religious denominations and this act is for Hindus only, which is not only against the fundamental rights but also the constitution, It needs to be challenged, the council also added that the government runs on the act and can’t run temples also a few extracts were filed from various supreme court judgments of 1974 by the petitioners.
To the proceeding, the court has directed that the copies of the documents & petitions to be forwarded for counter-affidavit to the advocate general for the state.
The court has given four weeks for the counter affidavit to be prepared therefore, the matter will be heard again on October 5, 2021.
