The Supreme Court has issued a stay on the Delhi High Court’s order, which effectively permitted bike-taxi aggregators Rapido and Uber to continue their operations in the national capital. Nevertheless, the Supreme Court has granted the aggregators the freedom to request an urgent hearing of their plea before the Delhi High Court. This development puts a halt to the operation of bike-taxi services by Rapido and Uber in Delhi, pending further court proceedings. The order was issued after the Supreme Court took into account two petitions from the Delhi government challenging a high court decision allowing Rapido and Uber, two bike-taxi aggregators, to continue operating in the nation’s capital until the administration announced its final guidelines for the use of two-wheelers other than for transportation. However, the vacation bench, which was made up of Justices Aniruddha Bose and Rajesh Bindal, gave the aggregators the right to ask for an urgent hearing of their case before the Delhi High Court during the course of the case’s hearing.

The Delhi High Court’s judgement instructing the government not to take any coercive action against the bike-taxi aggregators until a definitive policy was formally issued was challenged by the Aam Aadmi Party-led Delhi government. Prior to the announcement of the final rules, the high court had specifically ordered that no disciplinary actions be taken against the bike-taxi aggregator. Senior attorney Manish Vashisht argued on behalf of the Delhi government that the high court’s decision to delay the government’s notice until the final policy was implemented amounted to an effective grant of Rapido’s writ suit. The Delhi government issued a warning against the use of bike-taxis earlier this year and stated that violators could face fines of up to Rs 1 lakh.
