Review petitions submitted to challenge the Supreme Court’s ruling which upheld the validity of a 103rd Constitution Amendment that provides 10 % quota for economic weaker sections of society were dismissed by the Supreme Court this past week. By judgment delivered on May 9, the bench of CJD Chandrachud, Justice Dinesh Maheshwari, Bela M Trivedi, JB Pardiwala and S Ravindra Bhat concluded that there was no error to be drawn from its decision dated November 2022.

The Court held that there has been no apparent error in the record as a result of use of the review petitions. Under order XLVII, 1 of the Supreme Court Rules 2013, there is no case for review. Consequently, the review requests are dismissed[1]. Additionally, open court hearing is also denied by the court.

On November 7 of the previous year, a Constitutional Bench of the Supreme Court affirmed the Constitutionality of the reservation for Economically Weaker Sections (EWS).

Review petitions were filed against the judgment by Dravida Munnetra Kazhagam (DMK) party and Madhya Pradesh Congress leader, Dr. Jaya Thakur[2].
