 The Supreme Court dismissed a PIL on Friday, October 13, which challenged the Darwinian theory of evolution and Einstein’s equation (E=MC²). The bench, comprising Justices Sanjay Kishan Kaul and Sudhanshu Dhulia, stated in their order that the petitioner wanted to prove the Darwinian theory of evolution and Einstein’s equation wrong and was seeking a platform for the same. The judges observed that if that was the petitioner’s belief, he could propagate it himself, but it could not be a writ petition under Article 32 of the Indian Constitution that deals with fundamental rights. 

 At the beginning of the hearing, the petitioner, representing himself, argued that he had studied the theory of evolution and Einstein’s equation in school and college, but now believed they were wrong. Justice Kaul suggested that the petitioner should improve his theory, and the Supreme Court had nothing to do with it. The judge further pointed out that the petitioner’s fundamental rights were not violated under Article 32.  

When the petitioner asked where he should go, Justice Kaul replied that the court had no advisory jurisdiction to tell him. The judge added that the Supreme Court would not say that Newton or Einstein was wrong – it was a 32 petition. If the petitioner believed that two theories that had existed for a long time were wrong, he could propagate his own theory, but it was not the court’s concern. 

The petitioner tried to convince the bench that 20 million people have died accepting Darwin’s theory, but Justice Kaul clarified that these were not adjudicated rights. The case title was “Raj Kumar Petitioner-in-Person versus Union of India.”
