The Supreme Court took severe action against a lawyer on Friday after the lawyer filed a contempt petition against the court’s employees for failing to list a case despite the court’s order, branding the move an abuse of the process of law and an attempt to browbeat the registry. The Secretary-General and the Registrar (Listing) cannot be held in contempt of court simply because a case has not been listed on a date set by the court, according to a panel of Justices B R Gavai and Prashant Kumar Mishra.
The current contempt petition is nothing more than a violation of the legal system. Even when the court orders that a case be listed on a specific day, there are still obstacles that prevent it from happening. The bench rejected the plea, saying that bringing a contempt case against the registration for failing to include such a thing was an attempt to bully the registry.
When Supreme Court Bar Association (SCBA) president Adish Aggarwal offered an unqualified apology while he was in the courtroom for another issue, the top court refrained from fining the attorney in question.
The bench reprimanded the attorney, saying that rather than filing a contempt petition, the attorney should have brought a complaint to the top court’s administrative division.
In connection with a bail request in a case of suicide aid, the highest court was considering a plea of contempt. Despite a directive from the top court, the lawyer claimed that the register had not listed the case.
