The Lok Sabha passed the Government of NCT of Delhi (Amendment) Bill, 2023 on Wednesday, to replace the President of India’s Delhi Services Ordinance.

The Bill attempts to grant the Lieutenant Governor (LG) of Delhi veto authority over transfers, postings, and control over personnel in the capital region. The Bill introduced by the Centre differs significantly from the Ordinance promulgated by it on May 19, a week after the Supreme Court ruled that the Delhi Government has authority over the administration and control of civil servants except in matters of public order, police, and land. Section 3A of the Ordinance was a critical clause, stating that the Delhi Legislative Assembly (and hence the Delhi Government) shall not have authority over Entry 41 of List II of the 7th Schedule of the Constitution, which refers to services. Notably, Section 3A stated that the provision shall apply “notwithstanding anything contained in any judgment, order, or decree of any Court,” implying that the Ordinance rendered the supreme court’s effect null and void.
