The Chhattisgarh High Court on thursday noted that a wife cannot be treated as a “bonded labour” by her in-laws including her husband. She can not be forced to stay with her in-laws if she is being threatened.

In the present case the couple broke up on May 27, 2016, due to some personal differences. The husband in his statement said that his wife did not want to stay with his parents and that she also objected his parents visit to their house.

While according to the wife, dowry was demanded from her refusing to which she was subjected to torture and was threatened of grave consequences.

 The Chhattisgarh High Court observed that she seeemed to have been threatened by her in-laws because of which she had to leave her matrimonial house. The husband failed prove that she did not respect his parents.

Thus, the Court quashed the divorce decree awarded by the family court only after noting that the husband’s claim of desertion was not valid.
