
Facts of the case– There was a examination conducted by the West Bengal Board of Primary Education for the appointment of the teachers in 2016.The board and its officials including the former president of the board, who is in the custody of Enforcement Directorate for transaction of huge money in the recruitment process. This fraud cause the examination invalid and the case was filed before the High Court of Calcutta. The single judge bench headed by Justice Abhijit Gangopadhyay ruled that the examination must be reconducted for the appointment of 32000 teachers and it must be conducted within 3 months or till the end of the august.
The case was then presented before the Supreme Court and the petitioner argued that the ruling f HC was without hearing the people who were appointed as teachers and the decision was to reconduct the examination within 3 months which will be so expensive and next to impossible task.
Supreme Court after the hearing both the parties set aside the interim order passed by Calcutta High Court and terminated the order of fresh selection candidate.
