On 21 July (Friday) the Supreme Court declined to entertain a Public Interest Litigation which sought relief for inclusion of Rajasthani language to the 8th Schedule of the Constitution.
Prayers sought in the Petition were:
1. To direct the Union Of India to include the Rajasthani language in the 8th Schedule of the Constitution. Or,
2. To issue directions to the Union of India to accord same status and recognition to the Rajasthani language.
3. To issue directions to refrain from including Rajasthani language as dialect of Hindi to Union of India.
Observations made by the Court:
• The 8th Schedule of the Constitution is the matter which has to be dealt by Union.
• The Courts have the power of Judicial review, but it will not exercise such power in the matters if the state. However it may exercise such power if the policy made by the state violates the mandate of Constitution.
Subsequently the PIL was not entertained by the bench which consisted of CJI D.Y. Chandrachud, Justices J.B.Pardiwala and Manoj Misra.
