In the case of, Harendra Rai Vs. State of Bihar &Ors., the Supreme Court opposed the Patna High Court, the Bihar Police, and the Public Prosecutor for handling a murder case in which Mr. (Prabhunath Singh) Rashtriya Janata Dal Leader and former M.P., was the main accused in the case. The Apex Court termed the case as the most exceptionally painful case of our Criminal Justice System while holding him guilty for the 1995 murders of both Daroga Rai and Rajendra Rai, and the attempt to murder a court witness, Lalmuni Devi.

The bench of Justices Sanjay Kishan Kaul, Abhay S. Oka, and Vikram Nath said that the courts, the police, and the prosecution all failed to fulfill their responsibilities and duties towards the victim and witness. The Supreme Court ordered the victim to be immediately taken into custody and produced before the Court so that they can decide the punishment for him. Currently, the accused is undergoing a life sentence in another murder case of 1995 as he was convicted for the murder of a legislator, Ashok Singh.

However, the accused kidnapped the witness’s mother ten days before the date for recording her statement in front of the judge which led to the filing of a habeas corpus petition in the High Court. The Patna High Court revised the suo motu criminal petition but later refused to interfere with the order of acquittal which led to the appeal before the Supreme Court.
