The bench comprised of Justice Aniruddha Bose and Justice Sudhansu Dhulia issued notice on both special leave petition filed by Jyothi Jagtap and Professor Shoma Sen who were accused in the Bhima Koregaon Elgar Parishad case. Jagtap was a member of a cultural group banned by the CPI called Kabir Kala Manch [KKM]. Her bail was denied by the Bombay High court. In her bail application she stated that she was an artist and singer from the marginalized section of the society who also worked with several NGO’s. She argued that the NIA agency has not discovered anything new about her. As per the NIA Milind Teltumbde who died last year had a discussion about the Elgar parishad conclave with three members from the group and these three has helped to spread Maoist ideology throughout the event which broke out violence. She was Accused to be the main conspirator and they she was also accused of undergoing special training in the Korchi forest. Sen is an English literature professor who was arrested on 6th June 2018.She approached the high court for bail in October 2020. The Bombay High court discharged her pleas and granted her the liberty of approaching the trial court. She in her bail plea claimed that she was falsely arrested and implied in the present case with prejudiced and mala fide intention because of exposing a lot of illegal arrests. The electronic evidence against her had a doubtful Authenticity. She also claimed that she was a senior citizen who had medications for various diseases, her health was deteriorated, and it would become worse further.
Bhima Koregoan is a village near Pune which saw the historic battle between Peshawar’s and Dalits in 1881. Peshawar’s discriminated against Dalits as they were the lower caste when they said they need to be a part of kingdom’s operations. East India company who took advantage of this condition and declared a war against Peshawar’s and assembled Dalits to defend them. A brawl broke out between the Peshawar’s and Dalits when they assembled to commemorate the 200th anniversary of their victory at Vijay Stamp, a creation by east India company to pay tribute to all the Dalits who took part in the war.
The government prosecuted ten human rights advocates for delivering statements which incite violence on 31st December 2017 at Elgar Parishad conclave. They were arrested even before the charge sheet was filed. The Maharashtra government initially handled this case, and the government later transferred it to the National investigation agency without agreement with the state government. The campaigners were arrested for having Maoist ties relations.
