Right to Freedom of Religion Doesn’t Include Fundamental Right to Convert: Union Govt to SC
The Freedom of Religion does not include a fundamental right to convert people to other faiths, the Union government told the Supreme Court on Monday, 28 November.

It has also claimed that it is “cognisant of the menace” of alleged conversions and that the laws that “seek to control such practices are necessary to protect the cherished rights of vulnerable sections of the society including women and economically and socially backward classes.”
Ashwini Kumar Upadhyay, a leader of the Bharatiya Janata Party (BJP), requested strict measures to prevent fraudulent religious conversion by “intimidation” and through “gifts and monetary rewards.”

Upadhyay has submitted a number of petitions to the Supreme Court, almost all of which have a religious focus. These include requests for a uniform civil code, the abolition of certain portions of the Places of Worship (Special Provisions) Act, and challenging to certain Waqf Act provisions.
In connection with the chanting of anti-Muslim threats at a protest at the Jantar Mantar in 2021, Upadhyay was arrested.

When hearing the case, a bench of Justices M.R. Shah and C.T. Ravikumar, observed it was not against religious conversions but forced conversions, and asked the Union government to file a detailed affidavit on the issue after taking information from states.
“You file a detailed affidavit after obtaining the vital facts from the concerned States We aren’t against
conversion. But there cannot be any forced conversion,” the court observed.
The court deferred hearing on the petition as well as an impleadment application challenging its maintainability till December 5.
