Buxar, Bihar – In a recent legal case, a restaurant in Bihar faced consequences when it neglected to serve sambar with its popular “Special Masala Dosa,” leading to a penalty of Rs 3,500. The incident occurred on August 15, 2022, when lawyer Manish Gupta visited the Namak restaurant in Buxar to celebrate his birthday with a special treat.
Having paid Rs 140 for the eagerly anticipated masala dosa, Gupta was disappointed to discover that the customary accompaniment, sambar, was missing from the packed dish. Outraged by the oversight, he immediately visited the restaurant to inquire about the absence of sambar.
According to reports, the restaurant owner responded dismissively, allegedly saying, “Do you want to buy the whole restaurant for Rs 140?” Unsatisfied with this reply, Gupta decided to take legal action against the establishment. He served a notice to the restaurant, demanding an explanation. However, when the owner failed to respond, Gupta escalated the matter by filing a formal complaint with the District Consumer Commission.
Following a lengthy 11-month wait for a resolution, the Division Bench of the Consumer Commission, consisting of Chairman Ved Prakash Singh and member Varun Kumar, finally reached a decision. They found the restaurant guilty of negligence in failing to serve the customary sambar with the masala dosa. As a result, the restaurant was ordered to pay a fine of Rs 3,500.
The ruling serves as a reminder to restaurants and food establishments to uphold traditional practices and fulfill customer expectations when serving popular dishes. Neglecting to provide customary accompaniments may result in legal repercussions, emphasizing the importance of consumer rights in such matters.[1]
