Twenty second law commission in its report said that section 124 A of the indian penal code dealing with sedition should be retained but with certain amendements for greater clarity regarding its usage.
Sedition law should not be repealed just on the ground that it is a colonial legacy. but in view the commission recommended the guidelines to avoid its misuse by the enforcement agencies.
The panel said that a law should not be repealed just on the basis that its origin is colonial and if we go by that logic then the whole indian legal framework is a colonial legacy .for ex: police force,All india civil service . hence colonial laws are normatively neutral and the problem lies in its usage and that need to be resolved .
Further they suggested that sec 124 A can also have a proviso analogous to sec 196(3) of criminal procedure code is to sec 154 of crpc for procedural safeguard.
Various laws are being misused to fulfill their vested interest but it does not make a call for its repeal but for a procedural safeguard.
