In the case of, the State of Rajasthan vs. Iqbal Abdul Rehman, the Rajasthan High Court observed that it is nearly impossible for the prosecution to prove a relationship by direct evidence because the affairs can be proved only by relying on witness statements. Justices Vijay Bishnoi and Rajendra Prakash Soni observed that confirming the acquittal of a woman and her alleged lover, they both were accused of killing her mother-in-law. This kind of relationship is at a very advanced stage of intimate relations.
The Court was dealing with a criminal appeal that was filed by the State for challenging the acquittal of two persons, both of them were booked for the alleged murder of Bhagwanti’s mother-in-law. They both were in a relationship, which has been objected to by the deceased mother-in-law several times. But they both had grudges against her and eventually committed murder. The accused i.e., Bhagwanti’s husband was living in Bombay when she got involved in an extramarital affair with Abdul.
The Court held that the prosecution failed to prove the committed crime, the alleged relation between both the accused, or the motive for the alleged murder. Therefore, the Court upheld the acquittal of both the accused.
