The Supreme Court of India has set aside an award by the Consumer Forum, stating that the Indian Railways cannot be held liable for the theft of a passenger’s belongings. The ruling was made in a case involving an incident of theft on a train.

According to the Supreme Court’s decision, the Indian Railways cannot be held responsible for the criminal actions of third parties, such as theft or robbery, unless there is evidence of negligence or misconduct on the part of the railway administration. The court held that the railways cannot be expected to guarantee the security of passengers’ belongings beyond reasonable measures.

The court emphasized that the primary responsibility for safeguarding personal belongings lies with the passengers themselves. It stated that passengers should exercise due care and take necessary precautions to protect their belongings during train journeys.

This ruling establishes an important precedent regarding the liability of the Indian Railways in cases of theft or loss of passengers’ belongings. It highlights the need for passengers to be vigilant and take necessary precautions to ensure the safety of their possessions while traveling on trains.
