It was informed to the High Court of Karnataka by the National School of India University, Bengaluru, that the University’s Executive Council has decided to not grant reservation for transgender individuals to get admissions for NLSAT 3-years law course, 2023 that the University offers. A person named Mugil Anbu Vasantha filed a petition in the Court after not getting qualified for the admission in this National Law University. Vasantha has asked the University and the State Government for the implementation of Transgender’s policy of 2017 by the Karnataka State and provide reservation for getting admission to the said course.
The University however in the objection statement has stated that they have not opted for giving reservations to transgender individuals for the upcoming academic year. In continuation, it was also claimed by the University that they are not mandated to compulsorily ensure reservations to transgender persons and thus they have neither made any discrimination against them nor have violated any of their rights.
The University who is a Respondent in this case has also put forward their claim in front of the Court regarding their Inclusion and Expansion Plan for the period of 2021-2025 and has said that their plan and other aspects included are in adherence to the legal framework and are ensuring that all the community sections are having equal opportunity to participate in the University programs and access the opportunities offered thereby by adapting various measures which includes inclusive policy for students belonging to the community of transgender.
Additionally, the University has further claimed that the scheme regarding reservations was notified clearly to the applicants and the petitioner being completely aware of this had applied for the course in the general category. On Monday, Justice Ashok S Kinagi in this matter has granted a week’s time to the Karnataka State Government to file a reply and the matter has been put off to August 21 for the purpose of hearing.
