The MP High Court has refused to quash the order of MP-MLA Court of Gwalior which had took cognizance of a defamation complaint which was filed against Digvijay Singh who was the former Chief Minister for his remarks that said “BJP & RSS people are detectives of Pakistan”.
The complaint was filed by Abdish Singh (respondent) under the sections 499 & 500 of the Indian Penal Code which stated that he was an advocate, a worker of RSS and also an inviting member of the BJP. The complaint states that in the August month of 2019 the ex-CM (who’s the petitioner) had blamed the workers of RSS & BJP falsely. He had also said that mostly the people who were caught red handed working for the ISI were non-muslims.
The petitioner had approached the court on the ground that the order of the Magistrate in order to register the defamation complaint was passed as the complaint at the side of the respondent was not maintainable and might be a chance that it was filed either by the RSS or BJP.
The court on this observed that the complainant was a Hindu and was also related to both the organizations as well, so his feelings or image had gone damaged whether directly or indirectly.
