Facts of the Case – Mr. Shekhar were public figure and has substantial reach on social media posted a news against a women reporter which is derogatory in its remarks. The post was defamatory to the women class at large also.

Mr. Shekhar argued that he subsequently take off the post from the social media and apologied for the same. He also argued that he posted the note without reading it and it was a forwarded message. He got this from one Thirumalai Sadagopan from California.

Court said that when the post was taken down, damages has been caused already t the petitioner, and told to defendant that mere apology is not sufficient , since the damage has been caused to the petitioner already and defendant was a public figure he must have known the consequence of his doings and once the message is sent to the public the sender is only responsible for all the damages caused.
