A divisional Judge bench was hearing a Plea which challenged the order of the Allahabad High Court on May 26. The order of the Allahabad High court stated to transfer all pending suits related to the Krishna Janmabhoomi – Shahi Idagh from Trial court Mathura to itself.
While the dispute was still pending in the Trial Court the Hindu party moved to High Court to transfer all the pending matters of the said dispute. The Committee management trust of Shahi Idagh mosque preferred an Appeal challenging the order of the High Court.
Advocate Tasneem Ahmadi argued that the Trial Court is equally competent to the matter in dispute. She also stated that there is no delay in the case as the suit was filed from 2020.
The Hindu side contended that the issue involved concerns the crores of Lord Krishna’s devotees and it is a matter of National Importance. Also stated that the case involves a substantial question of law.
The Supreme Court observed that it would be better if the matter is heard by the High Court as the level of application of mind will be different. Bench sought to extract all the details regarding the cases of the said dispute from Registrar of the Allahabad High Court, then it will decide where the case should be tried. The matter was listed after 3 weeks.
