Anand Grover, a senior advocate, informed the court that when their offices were looted, the attorneys involved in the High Court case had to put up their briefs.
In the criminal lawsuit brought against retired colonel Vijaykant Chenji because of his 2019 book, The Anglo-Kuki War 1917–1919, the Supreme Court mandated on Tuesday that no coercive measures be taken against him.
Notice in the case was issued by a bench consisting of Chief Justice of India DY Chandrachud and Justices JB Pardiwala and Manoj Misra.
Senior Advocate Anand Grover, who was representing Chenji, claimed that the attorneys who were involved in the High Court case had to leave because their offices had been broken into.
Tushar Mehta, the Solicitor General, urged the Court to take into account the “pattern” and more general consequences of such instances. Additionally, he asked the Chief Justice to ask the Secretary General of the Court to check on the efficiency of the Manipur High Court.
The Court promised Chenji protection from coercive action up until the next hearing date in response to Grover’s worries.
“Release notification. An affidavit claiming that it is impossible to retain legal representation to appear before the High Court would be filed, according to Mr. Anand Grover’s submission. Until the next hearing date, you should be protected from coercion. Serve as the State of Manipur’s permanent counsel.
Another petitioner, a professor involved in the same case, was also given the same protection by the Bench.
The CJI stressed in response to SG Mehta’s assertion that the petitioners ought to have contacted the Manipur High Court,
Before we can further set up legal help, we must determine to the satisfaction of our conscience that attorneys are not present. Although I will not allow the Supreme Court to have Section 482 CrPC (inherent powers of High Court) jurisdiction, we are aware of this.
Chenji said in his motion that the first information report (FIR) filed against him for the book was never served to him. He claimed that this violated his fundamental rights, which is what prompted him to petition the supreme court.
He asserted that the filing of the FIR against him at the request of an organization named Federation of Haomee was done so to persecute and harass him at a time when the State of Manipur was under attack from sectarian conflict.
Violence has lately broken out between the Scheduled Tribe Kuki group and the Metei community in Manipur.
The Manipur High Court directed the State government to take into consideration adding the Meetei/Meitei group to the Scheduled Tribe list on April 19, 2023, which sparked unrest and violence in the State.
