The background of the case is the Hindu worshipers moved a suit before the Varanasi Court seeking a right to worship maa Shringar Gauri on the outer wall of the mosque complex which is located in next to the Kashi Vishwanath temple.The plantives have claimed that the present mosque premises was a Hindu temple and it was demolished by Mughal ruler Aurangzeb and there after the present mosque structure was built. The maintainability of that very suit was challenged by the Anjuman committee last year (2022) by way of filing an application under order 7 rule of CPC arguing that Hindu worshipper suit is barred by places of Worship Act 1991.However the objection was rejected by the Varanasi court in September last year (2022). Then then the Anjuman committee filed a revision plea before the Allahabad High Court against this rejection last year(2022) in December the bench of Justice J.J. Munir had reserved judgement after hearing councils of both the parties at length. Today ( 02/06/2023) the High Court has dismissed the revision plea moved by the Anjuman mosque committee.
