The Supreme Courts Bench of CJI Chandrachud and Justic PS Narsimha refused to entertain a PIL filed by an advocate and BJP Leader Ashwini Upadhyay who sought directions to double the number of judges in the trial courts and High Courts of India.
The Bench stated that “such simplistic solutions and populist measures might not solve the problem”
The Chief Justice added that the plea of getting more judges would not solve any problem and that the Court will not entertain pleas of this nature.
In his plea Adv. Upadhyay stated that the instant plea is in the form of a Public Interest Litigation as crores of Indians are suffering because of the pendency of cases and the courts are also getting overburdened.
As per the Bench, the plea was just like the Parliament stating that an act should be passed to ensure that cases are disposed within six months. The court also observed that studies suggest that merely raising the number of judges is not a solution for the pendency of matters.
Upon this the petitioner submitted that all the developed countires have more judges. The Bench stated that such pleas will not be entertained even in USA & UK and asked the petitioner to come with proper research.
Under the arguments presented before the court,  the petition was dismissed.
