
In the Case of Shivam Kumar Pal v. State of Uttar Pradesh, the women had filed a false FIR i.e. First Information Report against a man under rape charges. Shivam Kumar was accused for Rape under IPC Section 306, Criminal Breach of Trust under IPC Section 406 and Criminal Intimidation Under IPC Section 506. Here the accused stated that the FIR is counterfeit. And the complainant has been solemnized their marriage as both are major in nature. And are living happily together.
In this Case, the Allahabad High court later stated that the women had noted to the Commissioner of Police, that contended FIR has been the fabricated and filed in huff. Thus, women were fined for Rs 10,000 for filing a false charge against the man.
The Bench of Justice Anjani Kumar Mishra and Justice Vivek Kumar Singh stated that Criminal Justice cannot be used as a tool to take any personal revenge. Thus, this order states, The false allegations against any person have been one of the serious issues and in the criminal justice system such type of FIR and statement cannot be permitted. And a huge hand of punishment and fine must be enacted against such fabricated allegations against any person.
Thus, such cases of filing a false petition against the person have gone a trend and this must be addressed with the heavy hand.
