In this case the petitioner and the accused 2 were in the illicit relationship. Husband of the petitioner brought the petitioner and his child with him to Bengaluru for the education. Upon the conspiracy with the accused 2 and after instigation to kill the husband. The petitioner took the knife and stabbed her husband. To hide the secret she made a false story where she claimed that it was the incident of robbery and in that secret she harmed herself too to make believe of her story.
The council of the petitioner pronounced that the claims which were made against the petitioner are false and petitioned that the petitioner is a woman, she has been in jail since September 2022. But the materialistic facts of the case goes against the petitioner as the son of her is the witness in this case. It was believed that if she gets bail then she might try to interfere or might hamper evidence against her.
Further the court pointing out that there is a prima- facia case against the petitioner. Considering the gravity of the offence, the court dismissed the petition stating that merely the petitioner is women which is not a ground to enlarge her on bail.
