The case was registered on June 23rd, 2023 at Okhla Industrial Area on the basis of victim’s statement. She said that when she was sitting near the staircase of her house, the accused, who is her neighbour, suddenly came across her and showed his private part, and uttered something to her. She told the incident to her father and complaint was filed against the accused.
The complaint was registered under section 509 Indian Penal Code which says that word, gesture or act intended to insult the modesty of a woman is punishable, and section 12 of the Protection of Children from sexual offences (POCSO) Act, 2012, which talks about sexual harassment. This section deals with the sexual harassment of a child, which is punishable under Section 12 of the Protection of Children from Sexual Offences (POCSO) Act, 2012, is a cognizable and non-bailable offense.
The bail was denied by the POCSO court on July 24th and the Delhi Police authority was told to provide rehabilitation services to the victim who is totally traumatized as such an incident imprint a deep trauma on the victim. As the incident causes mental agony and disturbances to the victim ( below 18 years old) , it affects her normal life and survival. She has been deeply traumatized by such vulgar incident hence she shall be provided rehabilitation services to come back in her normal state of mind.
Recently, in August 22, 2023, the court proceeded to grant bail to the accused as he is mentally unsound and there is no prior report or history of touching of victim and verbal abuse. Moreover, the IO is ordered to get the counseling session organized for the victim. In this regard some NGO may be communicated and appropriate counselling session should be conducted.
