The State government argued that the amendment was made to bring the prison rules in line with constitutional principles of equality and non-discrimination. It stated that every prisoner, regardless of the nature of their offense, should be entitled to the benefit of premature release based on established criteria.

The affidavit also highlighted that the decision to release Anand Mohan was taken by the State Sentence Review Board, a competent authority empowered to consider cases of premature release based on the guidelines and criteria set by the government.

The Bihar government’s response comes in the backdrop of the plea filed by Uma Krishnaiah, who sought the quashing of the amendment and the premature release of Anand Mohan. She contended that the alteration of prison rules was done with mala fide intentions to favor the former MP. The Supreme Court will now consider the arguments presented by both parties before making a decision in the matter.

Anand Mohan, a former Member of Parliament, was convicted in multiple criminal cases, including the murder of District Magistrate G Krishnaiah. His release from prison has sparked controversy and raised questions about the fairness of the legal process.

The case highlights the Importance of ensuring equal treatment under the law and the need to review and amend outdated prison rules that may perpetuate discrimination.
