The Supreme Court has held that Coal India Limited does come under the purview of Competition Act ,2002 . Despite being public sector undertaking.
The Supreme Court was hearing petition by Coal India contending that since it operates the coal mines covers under Coal Mine Nationalisation Act. It would be not come under the Competition Act . The Competition Commission of India had apposed the plea .
The Competition Commission of India has earlier imposed the forfeit of over rupees 1773 crore on Coal India for imposing (spectacularing )unfair and discriminatory conditions in fuel supplier arrangements with the power of producers for supply of non cookie coal.
The bench of Justice K. M. Joseph and Justice B. V. Nagarathna delivered the judgement today on 15/06/2023 and remanded the matter back to Competition Commission of India for deciding the issue on merits.
It also clarified that the applications seeking interim relief as well as contempt petitions will be listed in July.
