In a thought-provoking address at the Justice Keshav Chandra Dhulia Memorial Essay Competition, Chief Justice of India (CJI) DY Chandrachud underscored the delicate balance between majority rule and the imperative inclusion of minority perspectives in a thriving democracy. The CJI emphasized that while the majority “will have its way” in a democratic system, it is equally crucial for the minority to “have its say.”

Speaking on the theme of “Democracy, Debate and Dissent,” Justice Chandrachud elucidated the significance of upholding the rights and voices of the weaker sections of the population, whether in numerical or social terms. He acknowledged that this might seem contradictory to the democratic principle of majority rule, but he argued that the essence of democracy lies in the moral standing that enables all citizens to participate and find consensus in decision-making.

“In a democracy, the majority will have its way, but the minority must have its say,” emphasized the CJI, encapsulating the essence of his perspective on the dynamics of democratic governance.

Justice Chandrachud delved into the importance of open discourse in reinforcing democratic principles and highlighted the role of dissent in shaping a robust democratic society. He stated, “While deliberation sustains a democracy, dissent nourishes it,” emphasizing that the free expression of dissent contributes to the resilience and adaptability of a democratic system.

The CJI acknowledged that engaging in discussions may not always lead to immediate outcomes but emphasized that these exchanges become an integral part of a nation’s historical fabric, capable of being revisited and learned from in the future.

“While social harmony among citizens is a prerequisite for democracy, it cannot be manufactured by removing conditions under which dissent may be freely expressed. A society is often known by its great dissenters because dissenters inform us of the location and direction of a democracy,” Justice Chandrachud remarked, emphasizing that dissenters play a crucial role in steering the course of a democratic nation.
