
Justices BR Gavai and Surya Kant have been added to the five-judge collegium headed by Chief Justice of India DY Chandrachud after two senior justices resigned their positions over the summer vacation.
On June 16 and 17, respectively, Justices KM Joseph and Ajay Rastogi, who were members of the collegium, retired.
The CJI is now joined by Justices Sanjay Kishan Kaul, Sanjiv Khanna, BR Gavai, and Surya Kant in the reorganised collegium. It’s interesting to note that Justices Khanna, Gavai, and Surya Kant would eventually become the Chief Justice of India.
With Justice V. Ramasubramanian’s retirement on Thursday, the Supreme Court will have 31 instead of the sanctioned 34 vacancies, putting the onus on the newly formed collegium to replace them.
The number of justices will drop to 30 in the first week after the highest court resumes operations following the summer break, with Justice Krishna Murari scheduled to step down from his position on July 8. The Supreme Court will resume on July 3 following the summer break.
With the addition of Justice Khanna in lieu of Justice Joseph, the three-member collegium that recommends candidates for high court judge appointments has also experienced a shift. Justice Sanjay Kishan Kaul is a member of the panel led by Chief Justice Chandrachud.
