
On Wednesday, in the case of, In Re: Article 370 of the Constitution, the Supreme Court said there should be no confusion with the Central government’s legal powers to repeal Article 370 and the alleged abuse of process. The Constitution Bench of D.Y. Chandrachud (C.J.I.) and Justices Sanjay Kishan Kaul, Sanjiv Khanna, B.R. Gavai, and Surya Kant heard the arguments of both councils.
It was the 60th-day hearing of the petitions which challenges the Central government’s move and result in the revocation of the special status of Jammu and Kashmir (J&K). The Union Home Ministry filed an affidavit before the Court stating that after the repealing of Article 370, Jammu & Kashmir has witnessed stability and progress.
Senior Advocate said that Article 370 was a promise made regarding the special status which could not have been breached by the law. Article 370 is temporary by the object of the purpose and once that purpose is served then nothing remains for the President to exercise. Then, the council emphasized constitutionalism which would trump argued urged by the Central government in favor of the repeal. The CJI D.Y. Chandrachud asked counsels to conclude their arguments by Tuesday, August 22, 2023.
