The Allahabad High Court fined a woman Rs. 10,000 for filing a First Information Report (FIR) against four men, alleging falsely that they had engaged in rape and unnatural intercourse with her.

The court was addressing a writ petition submitted by accused individuals who claimed the FIR against them was false and made up. The court was further informed that the petitioner no. 1 and the first informant, who is the claimed rape victim, had gotten married legally and are now living happily and willingly together as husband and wife.

The woman had previously written a letter to the police commissioner in Prayagraj confessing that the rape charge she had brought against the person in question was incorrect and had been brought in a fury. This letter was also attached to the defendant’s motion to have the rape case against him dismissed.

The High Court read the victim’s letter and observed that the complaint against the petitioner was false and had been made as a result of certain issues that had arisen between her and the accused.

The criminal justice system cannot be used as a way to settle personal scores, the courtroom bench consisting Justice Anjani Kumar Mishra and Justice Vivek Kumar Singh stated. The High Court further stated that the practice of filing FIRs and making false, serious rape charges cannot be tolerated and must be treated with “heavy hand.”

Additionally, while granting the petition, the court imposed a cost of Rs. 10,000 that was to be paid by the claimed victim within 10 days period.
