"Unintentional Error": High Court Comments In "Mr Put Mine, Backer" Matter

In suo moto proceedings that were initiated in the case of an Advocate whose name was recorded as “Mr. Put Mine, Advocate” in the record of proceedings, the Supreme Court made the observation that the incident was a mistake that was not made with intent.

A picture of the proceedings was widely shared on WhatsApp and other social media platforms, drawing a lot of attention to the incident. While the error “caused a lot of embarrassment to this (Supreme) Court,” the bench of Justices Krishna Murari and Sanjay Karol noted that it was unintentional and “due to an inadvertence without any motive or mala fide intention.”

Along with Senior Advocates K.V. Viswanathan and Mukul Rohatgi, the Advocate on Record, whose name was recorded as “Mr Put Mine,” appeared before the Supreme Court. According to their respective arguments, the error was brought about by an unintentional oversight on the part of the clerk of the Advocate on Record when she transmitted the WhatsApp message from the Advocate, who requested that his name be included in the Record of Proceeding. “The Clerk received the message on WhatsApp that was “Put Mine,” though in reality, what he wanted to communicate was that his name be also recorded in the proceeding,” the court stated. The message as received was accidentally forwarded and uploaded to the portal’s online appearance, where proceedings were initiated under the name “Mr. Put Mine, Advocate.” As a result, the Court Officer entered the same information into the proceedings record.”

The bench said that the error was genuine, despite the fact that the Advocate in question was a young lawyer who had offered an unqualified apology to the Apex Court for the embarrassment. As a result, it acknowledged the lawyer’s apology and stated that neither the Clerk nor the Court Officers, nor the Advocate on Record, required any further action.
