AAP leaders have suffered a setback in the criminal defamation case filed by Gujarat University over Prime Minister Narendra Modi’s degree. The Gujarat High Court on Thursday refused to stay the summons issued by a magistrate court to Aam Aadmi Party leaders Arvind Kejriwal and Sanjay Singh. The hearing in the case was going on for several months.

For context , both AAP leaders have moved the high court seeking quashing of a summons issued by a magistrate court(Ahmedabad) in the defamation complaint against them over their alleged comments ‘targeting’ the Gujarat university seeking the educational degree of a PM Modi.

The Gujarat High Court on Thursday refused to stay the summons issued by a magistrate court to Aam Aadmi Party leaders Arvind Kejriwal and Sanjay Singh.

Refusing grant to any interim relief by way of staying case proceedings, a bench of Justice JC Doshi today also issued a notice to the Gujrat University and adjourned the hearing in the matter to November 3.

Senior advocate Rebecca John and advocate Aum Kotwal appeared on behalf of the two AAP leaders on Thursday. The notice has been kept returnable by November 3, when the court is due to take up the matter next.

With the magistrate court due to take up the criminal defamation trial on October 14, the court of Justice J C Doshi, however, refused to accede to requests by the petitioners to direct for a stay or adjournment on the trial while the petitions are pending before the high court. A request to direct the magistrate court to consider an adjournment application if moved by the petitioners was also refused by Justice Doshi.
