The state government is directed to issue all state-owned corporations to provide 1% reservations for employment of transgenders by the Karnataka high court.

The government however issued a notice last month providing 1% horizontal reservation for transgenders in government jobs which is applicable to all the other categories like General Merits, SC, ST, etc.

Amendments were made in the Karnataka civil services (general recruitment) (amendment) rules, 2021, to provide reservations of 1% to transgenders for government jobs.

The matter came up when several applications were filed demanding reservations in public authorities. However, the state government said that these sectors have their own service rules and will only be concerned when the court will direct them to do so.

The court mentioned that it is an innovative step and the state government must issue directions to state-owned corporations & statutory authorities for the matter.

The court issued the notice after a petition filed by Sangama society which is working for sex workers, minorities, HIV infected people & for their upliftment.

They took into consideration the case of NALSA vs. union of India, where the “third gender” category is totally ignored in the job appointment categories & argued that the court must look into the matter just like the Supreme Court did, whereby legal rights of the third gender persons were recognized & were provided with fundamental & constitutional rights.

The notification seeks to add a third category of transgenders for the job posts owned by the state & also provide for reservations.
