
After the Gujrat Court verdict, Congress leader and Wayanad MP Rahul Gandhi has been again directed to appear in Bihar Patna MP/MLA Court on 12th of April to record statement in defamation case under section 313 of CRPC , which was filled by Rajya Sabha MP Sushil Modi for a remark he made ahead of 2019 that all those having Modi surname are thieves.
“Congress leader Rahul Gandhi, with his remark during 2019 lok sabha election, in Kolar Karnataka, insulted backward class people like me and because of which I had filled a defamation petition against him” MP Modi said in a video message. “The Court has issued summons to him to record his statement . Rahul Gandhi had to surrender in the case on 6 July 2019 and currently he is on bail. I hope, similar to Gujarat court , this court (Patna) would also take cognisance of my petition and punish him appropriately” he added.Other then Sushil Modi, court has already recorded statements of former minister-cum- Bankipur MLA Nitin Navin, Digha MLA Sanjiv Chaurasia and Bharatiya Janta Yuva Morcha leader Manish Kumar as witnesses.
On 23rd march, Rahul Gandhi was held guilty on his controversial statement saying “ how come all the thieves have Modi as the common surname?” during a rally in Kolar Karnataka in 2019 and got sentenced to jail for 2 year by a Gujrat court of judicial chief magistrate H.H. Verma under IPC section 499 and 500.
The court approved his bail on a surety of ₹15,000 and suspended the sentence for 30 days to allow him to appeal in higher courts. There is no confirmation from Rahul Gandhi or the Bihar congress legal team if he is available to go for the summon on 12 April or appeal for another day. While a senior state congress leader and other congress leaders of Bihar said that they were not yet aware of any summon issued to Rahul Gandhi from Patna court.
