ABSTRACT
Artificial Intelligence-powered surveillance refers to the use of smart technologies such as facial-recognition, biometric systems, predictive policing, and digital monitoring to observe , track, and analyse people’s activities. While these systems help governments improve security, prevent crime, and manage public services efficiently, they also raise serious concerns about privacy, dignity and other basic human rights. Excessive or unchecked surveillance can lead to misuse of power, discrimination, and loss of individual freedom. Therefore, balancing security needs with constitutional and human rights protection has become an important legal and ethical issue. This paper studies the meaning, objectives, legal framework, real-world examples, risks, and safeguards of AI-based surveillance to understand how it can be used responsibly and lawfully.

INTRODUCTION
Artificial intelligence has grown rapidly over the last decade and has become a part of everyday governance and security systems. Governments across the world are increasingly using AI – based surveillance tools such as CCTV networks, facial recognition technology, biometric databases, and predictive policing software to prevent crime, maintain public order, and improve administrative efficiency. These technologies help authorities monitor large populations, analyse huge amounts of data, and respond to threats more quickly than traditional methods. However, the growing use of AI for surveillance also raises serious concerns. Constant monitoring of individuals can interfere with privacy, freedom of speech, and personal liberty. When people know they are being watched, they may hesitate to express their opinions or participate in protests and public life. There are also risks of misuse of data, lack of transparency, and algorithmic bias, which can unfairly target certain communities. In this way, AI – powered surveillance creates a difficult question: how can the State ensure security without violating basic human rights?
In India, the use of technologies such as facial recognition systems and predictive policing has expanded in recent years, often without clear legal safeguards or accountability mechanisms. Although these tools are introduced in the name of safety and crime control, their unchecked use may conflict with constitutional protections, especially the right to privacy and dignity under Article 12. This makes it necessary to examine whether existing laws are sufficient to regulate such technologies. This paper therefore studies the relationship between AI – powered surveillance and human rights. It discusses the meaning and scope of surveillance technologies, their benefits and risks, the legal and constitutional issues involved, and the need for a balanced framework that protects both national security and individual freedoms.
MEANING AND SCOPE OF AI – POWERED SURVEILLANCE
In the last decade, surveillance systems have changed rapidly due to the growth of artificial intelligence. Traditional surveillance mainly relied on human observation and simple tools such as CCTV cameras that only recorded footage. These systems were passive in nature. They could capture events, but they could not understand or analyse them on their own. Human operators had to constantly monitor screens and manually identify threats, which was time-consuming and often ineffective. AI – powered surveillance goes a step further. It combines cameras, sensors, and large amounts of data with artificial intelligence and machine learning. Instead of merely recording information, these systems can automatically analyse it, detects patterns, and respond to suspicious activities in real time. In simple terms, AI makes surveillance “smarter” by allowing machines to recognizes faces, track movements, identify objects, and even predict possible risks without continuous human involvement. Because of this capability, surveillance today is no longer limited to watching spaces. It also involves collecting, storing, and analysing personal data. This wider process is sometimes referred to as “data-based surveillance” or “dataveillance”, where individuals are monitored not only through cameras but also through digital footprints such as biometric records, mobile data, and online activities.
The scope of AI – powered surveillance is therefore very broad. It includes several technologies and practices. Facial recognition systems are widely used to identify individuals in public places by matching faces with government or police databases. Biometric surveillance uses fingerprints, iris scans, or voice patterns for identification and access control. Predictive policing tools analyse past crime data to forecast where crimes might occur or who might be involved. Social media monitoring tracks online behaviour to detect dissent, threats, or suspicious communication. Network and digital surveillance systems monitor internet usage, calls, and location data to map peoples’s movements and relationships. These tools are now used by governments, law enforcement agencies, corporations, and even private organisations for purposes such as crime prevention, crowd control, traffic management, border security, and workplace monitoring. Supporters argue that such systems improve efficiency and public safety. However, the same technologies also raises serious concerns about privacy, misuse of data, profiling and constant monitoring of citizens. Thus, AI – powered surveillance has expanded both in scale and intensity. It is no longer limited to specific suspects but often affects entire populations. This shift makes it necessary to examine not only how these systems work, but also why they are being used and what goals they seek to achieve.
OBJECTIVES OF SURVEILLANCE
The primary objective of modern surveillance is to protect the nation and maintain law and order. With the rapid growth of artificial intelligence and digital technologies, governments are increasingly using smarter surveillance systems to monitor public spaces, borders, and sensitive areas. These systems help authorities observe activities in real time and detect suspicious behaviour at an early stage. By doing so, surveillance supports national security and helps prevent threats before they become serious problems. Surveillance also plays an important role in crime prevention and counter-terrorism. AI- based tools such as smart cameras, facial recognition, drones, and data analysis systems help track criminals, identify risks, and send quick alerts to security forces. This allows faster response and better decision-making. During emergencies or disasters, surveillance systems assist in rescue operations, crowd management, and maintaining public safety. In addition, surveillance helps in efficient governance. Automated systems reduce human effort, save time, and improve accuracy in monitoring large areas. They help government agencies manage resources better and carry out security operations more effectively. Therefore, modern surveillance is not only about watching people, but about ensuring safety, preventing crime, and improving overall security management.
HUMAN RIGHTS IMPLICATIONS
Although AI – powered surveillance systems are increasingly used to strengthen security and improve law enforcement, they also create serious concerns for the protection of human rights. These technologies rely on constant monitoring, data collection, and tracking of individuals through tools such as CCTV cameras, facial recognition, biometric databases, social media monitoring, and predictive analysis. As a result, people are often observed in their daily lives without their full knowledge or consent. This continuous surveillance can weaken the right to privacy and interfere with a person’s personal space, autonomy, and freedom to live without unnecessary state intrusion. Another major concern is the risk of discrimination and bias. AI systems are trained on large sets of data, and if this data is incomplete or biased, the system may unfairly target certain communities, especially minorities and vulnerable groups. For example, facial recognition tools have been shown to misidentify people based on race or gender, which can lead to false accusations, wrongful arrests, or unequal treatment. Such outcomes directly affect the right to equality and non-discrimination. AI surveillance may also affect freedom of expression and democratic participation. When individuals know they are constantly being watched, they may hesitate to speak freely, attend protests, or share their opinions online. This creates a “chilling effect”, where people limit their own behaviour out of fear of being monitored. Over time, this can weaken open debate and reduce public trust in institutions. In addition, many AI systems operate with limited transparency and accountability. People often do not understand how decisions are made or how their data is stored and used. If a person is wrongly flagged or targeted by an automated system, it can be difficult to challenge the decision or seek a remedy. This lack of clarity and oversight threatens the principles of fairness, due process, and justice. Therefore, while AI surveillance may help governments achieve goals such as national security, crime prevention, and public safety, it must be balanced with strong legal safeguards. Clear laws, human oversight, data protection measures, and respect for fundamental rights are necessary to ensure that security does not come at the cost of human dignity and civil liberties.
LEGAL & REGULATORY FRAMEWORK
The legal and regulatory framework for AI surveillance is built around the protection of privacy, dignity, and individual freedom at both the international and national levels. Internationally, the right to privacy is recognised under Article 12 of the Universal Declaration of Human Rights (UDHR) and Article 17 of the International Covenant on Civil and Political Rights (ICCPR), which protect individuals from arbitrary interference with their private life, family, and correspondence. In recent years, the United Nations has also stressed digital privacy principles, emphasising that even in the digital age, states must ensure consent, transparency, and safeguards against misuse of personal data. However, scholars and policy reports point out that while such frameworks set important standards, they often struggle to fully regulate modern AI-driven surveillance technologies like facial recognition, predictive analytics, and large-scale data monitoring. These systems collect vast amounts of personal information, often without clear consent, and their opaque algorithms make it difficult for individuals to understand or challenge decisions, raising concerns about misuse, bias, and lack of accountability.
In India, privacy protection has developed through both constitutional and statutory measures. Article 21 of the Constitution, which guarantees the right to life and personal liberty, has been interpreted by the Supreme Court in Justice K.S. Puttaswamy v. Union of India to include the fundamental right to privacy. This judgement requires the state to ensure legality, necessity, and proportionality in any form of surveillance or data collection. Further, the Information Technology Act, 2000 and its rules provide safeguards against unauthorized access and misuse of data, while the Digital Personal Data Protection Act, 2023 introduces clearer duties on data fiduciaries, consent requirements, and penalties for breaches. Yet, as recent research highlights, even these laws face practical challenges such as weak enforcement, lack of transparency in AI systems, and limited public awareness, which can reduce their effectiveness. Therefore, while international and Indian legal frameworks provide an essential foundation for protecting rights, stronger accountability mechanisms and clearer regulation are still needed to ensure that AI surveillance does not undermine privacy, equality, and human dignity.
CASE STUDIES
China provides one of the most discussed examples of large-scale AI surveillance in practice. The government has widely installed facial recognition cameras across streets, railway stations, airports, schools, and markets to monitor public movements in real time. These systems can quickly identify individuals, track their locations, and store their personal data. Along with this, China’s social credit system collects information about citizen’s financial records, online behaviour and social conduct to give them a score. People with higher scores may receive benefits such as easier access to loans or travel, while those with lower scores may face restrictions or penalties. Although these measures are promoted as tools for maintaining public order and discipline, they create a feeling of constant monitoring. Many critics argue that such systems reduce personal freedom and make people afraid to express themselves openly, as every action may be recorded and judged by the state.
The Pegasus spyware controversy in India highlights another serious form of digital surveillance. Pegasus, developed by the Israeli company NSO group, is a powerful spyware that can secretly enter a person’s phone without their knowledge and gain access to calls, messages, emails, camera, and microphone. Reports suggested that journalists, activists, opposition leaders, and other citizens were possible targets of this spyware. These allegations raised questions about whether government agencies were misusing surveillance tools against individuals instead of using them only for national security purposes. Several petitions were filed before the Supreme Court of India, and the court appointed an independent technical committee to investigate the matter. The controversy sparked a nationwide debate about the right to privacy, freedom of speech and the need for transparency and accountability in state surveillance practices. This shows that even when used for security reasons, such technologies can threaten civil liberties if proper safeguards and limits are not in place.
CHALLENGES & RISKS
Although artificial intelligence offers many benefits, it also brings several serious challenges and risks that cannot be ignored. One major issue is bias, as AI systems often learn from historical data that may already contain discrimination, leading to unfair results in areas like hiring, healthcare, and policing. AI also increases cyber security threats, since criminals can misuse it to create fake identities, clone voices, and carry out scams or hacking attacks. Privacy is another concern because many AI tools collect and process large amounts of personal data, often without clear consent from users. In addition, AI systems require huge amounts of energy and water, which raises environmental concern due to their carbon footprint. There are also social and economic risks, such as job losses caused by automation, lack of accountability when AI systems make harmful decisions, and the problem of “black box” algorithms that are difficult to explain or understand. The spread of misinformation through deepfakes and AI-generated content further threatens public trust and democracy. Together, these issues show that while AI is powerful, it can also create legal, ethical, and societal problems if not properly controlled.
SAFEGUARDS
To reduce these risks, strong safeguards and responsible governance are necessary. Organizations and governments must adopt clear AI policies that promote fairness, transparency, and accountability at every stage of development and use. Bias can be minimized by using diverse and representative data, testing systems regularly, and keeping human oversight in decision-making. Protecting privacy requires informing users about how their data is collected and giving them the choice to opt out. Cyber security can be strengthened through risk assessments, secure system design, and regular testing for vulnerabilities. At the same time, companies should invest in skilling workers so that AI supports human work rather than replacing it. Using explainable AI tools, keeping audit trails, and following ethical guidelines can also help build trust and responsibility. Overall, careful regulation, technical safeguards, and human supervision are essential to ensure that AI is used safely and for the benefit of society rather than causing harm.
CONCLUSION
AI-powered surveillance has become an important part of modern governance. Technologies such as facial recognition, biometric databases, predictive policing, and digital monitoring help governments improve national security, prevent crime, and maintain public safety. These tools make surveillance faster and more efficient, but they also raise serious concerns about privacy, freedom, and fairness. As seen in real-world examples like China’s facial recognition systems, the Pegasus spyware controversy in India, and police use of surveillance during protests, these technologies can sometimes be misused and may violate basic rights. Therefore, strong legal protections and safeguards are necessary. International human rights principles and Indian laws, including Article 21 and the Puttaswamy judgement, highlight the need to protect privacy and dignity while using such technologies. In the end, AI surveillance should aim for balance. Security is important, but it should not come at the cost of fundamental rights. With proper regulation, transparency, and accountability, AI can serve society responsibly rather than threaten individual freedoms.
