A Public Interest Litigation (PIL) asking for the cancellation of faculty appointments in Indian Institutes of Technology (IIT) from 2008 to the present for allegedly breaking reservation rules was recently dismissed by the Supreme Court. Additionally, the PIL demanded that candidates from northern and Hindi-speaking areas be given equal opportunity to apply for teaching seats at IITs across India.

A division bench of Justice Surya Kant and Justice Dipankar Datta dismissed the PIL, calling it “misconceived and misdirected,” ruling that the request to revoke appointments made as far back as 2008 cannot be considered. The Court further determined that there was no evidence to substantiate the allegations in the plea.

According to the complaint, some IIT students killed themselves as a result of harassment by teachers. The Court referred to the petitioner’s broad accusations as “absurd” and without merit.

The Court noted that the petitioner had recognised that the case regarding the application of the reservation policy in IITs is already under consideration by the Apex Court and the Madras High Court, and as a result, no separate writ was necessary to be considered with respect to the same problem.

It was said that- the petitioner’s request to reverse appointments made beginning in June 2008 cannot be granted at this late date, especially as none of the appointees is a party respondent. His claim of supposed discrimination against candidates from the north and Hindi-speaking States in the area of recruitment as faculty members at IITs is utterly evasive, imprecise, and devoid of any evidence. The petitioner has levelled broad accusations against a number of IIT students, alleging that they killed themselves as a result of harassment by IIT instructors. A few news headlines appear to have provided the foundation for such a ridiculous appeal.
