ALLAHABAD, Uttar Pradesh: In a significant legal development, the Allahabad High Court has recently rendered a verdict upholding the Special Investigation Team (SIT) probe into multiple Madrasas located in Azamgarh, under the ambit of the Uttar Pradesh Board of Madrasa Education Act, 2004. The ruling, issued on September 12, 2023, affirmed the state’s authority to take immediate action in accordance with the aforementioned Act, without necessitating consultation with the Board, in specific circumstances.

The case was brought before the court by concerned parties seeking the dismissal of the SIT probe initiated against the Madrasas. Central to the case was the interpretation of Section 13 of the Uttar Pradesh Board of Madrasa Education Act, 2004. This section bestows the State Government with the discretion to exercise its powers independently, without requiring prior approval from the Board, in situations outlined by the Act.

The Allahabad High Court, in its meticulously reasoned judgment, ruled that the State Government’s action in instituting the SIT probe was consistent with the provisions of the Act and well within its purview as defined under Section 13. The court emphasized that the Act grants the State the prerogative to safeguard the integrity of Madrasa education in Uttar Pradesh, particularly in cases where irregularities or violations are suspected.

The verdict affirms the principle of autonomy accorded to state authorities, in line with the legal framework, to ensure the maintenance of quality and compliance within educational institutions. This ruling, which highlights the importance of upholding the law in educational matters, is expected to have far-reaching implications for the governance and oversight of Madrasa education in Uttar Pradesh.
